Inland Revenue Will Catch Out the Unwary !
The following information is designed to help you avoid Inland Revenue fines.
The UK Inland Revenue are extremely keen to collect penalties from the unwary and the current Inland Revenue way of working is increasingly likely to do this ! Don't let the Inland Revenue catch you out.
Failure to do a whole variety of tax related forms or notifications by their respective deadlines can lead to hundreds and possibly thousands of pound in fines.
Form 42 - Share allocation notification
Form 42 is a annual return that is due for submission by 6 July after the end of the relevant tax year. Due to poor publicity and other problems with the form being downloaded from the Inland Revenue's website the Inland Revenue have for the year ended 5 April 2004 extended the deadline to 6 September 2004. If you formed your company between 6 April 2003 and 5 April 2004 you have in most cases till 6 September 2004 (to submit the declaration to the Inland Revenue. (see below now 30 November 2004).
Failure to complete the form and submit this to the Inland Revenue on time can lead to an Inland Revenue fine of up to £300 (for each failure).
At the time of company formation the Inland Revenue will accept the share details relevant at the time of formation in an abbreviated manner at the same time as submitting the CT41G (see below) which is also an important document and normally arrives at the company's registered office within a short period of time from incorporation and notifies the company of it's tax reference.
The form is 16 pages long but much of the form will not apply in many cases. Section 2a. "Acquisition of unrestricted securities" is in many cases the relevant section on formation.

On the 4 August 2004 the Inland Revenue announced a further extension to the form 42 deadline for the year ended 5 April 2004 to 30 November 2004!
Form CT41G - Initial company formation information
The Inland Revenue will automatically issue a Form CT41G to newly formed companies at the registered office normally very promptly after formation. Do not ignore this form. It is a fineable offence to not notify the company has commenced trading within three months of commencing to trade. If you have not received the CT41G within the three must we would advise you to write to the appropriate tax district to notify commencement of trading and request a CT41G for completion.

Other Inland Revenue forms on which there are penalties include the annual return CT600, P35 PAYE end of year return, P11D(b) and P11Ds benefits and expenses forms to name a few.
All these forms have deadlines and penalties for late or inaccurate completion. We would recommend you seek professional advice from the outset about the administration of your new company.
